Terms and conditions for our construction services

Acceptance of Terms

By accessing and using Takumi Deckworks services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Service Description

Takumi Deckworks provides professional deck and patio construction, design, and maintenance services throughout the Greater Tokyo Area and surrounding prefectures, specializing in seismic-rated construction and weather-resistant outdoor living solutions.

Construction Services

Our services include custom deck construction, patio installation, pergola building, repair services, design consultation, permit assistance, and ongoing maintenance programs.

Design and Planning

We provide comprehensive design services including AR previews, material selection, code compliance verification, and project planning tailored to Japanese building requirements.

Project Agreements and Contracts

All construction projects require a signed contract detailing scope of work, materials, timeline, pricing, and terms. Project agreements supersede these general terms for specific construction services.

Estimates and Pricing

Project estimates are valid for 30 days and subject to material cost fluctuations and site condition changes discovered during construction.

Change Orders

Any modifications to the original project scope must be documented in writing and may result in additional costs and timeline adjustments.

Payment Terms

Payment schedules are established in individual project contracts. Generally, we require a deposit upon contract signing, progress payments during construction, and final payment upon project completion.

Late Payments

Late payments may result in project delays and additional fees as specified in individual contracts. We reserve the right to suspend work for overdue accounts.

Disputed Charges

Any billing disputes must be raised within 30 days of invoice date. We will work to resolve disputes promptly and fairly.

Warranties and Guarantees

We provide warranties on our workmanship and guarantee compliance with local building codes. Specific warranty terms are detailed in individual project contracts.

Material Warranties

Material warranties are provided by manufacturers and passed through to customers. We assist with warranty claims but are not responsible for manufacturer defects.

Workmanship Guarantee

We guarantee our construction workmanship for the period specified in your project contract, typically ranging from one to five years depending on the scope of work.

Limitation of Liability

Our liability is limited to the contract value of services provided. We are not liable for indirect, consequential, or punitive damages arising from our services.

Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our control, including natural disasters, government actions, or material shortages.

Customer Responsibilities

Customers are responsible for providing accurate property information, obtaining necessary approvals from homeowner associations, and ensuring site accessibility for construction crews.

Site Preparation

Customers must ensure construction sites are accessible and free of obstacles unless site preparation is included in the project scope.

Permit Cooperation

While we handle permit applications, customers must cooperate with inspection processes and provide necessary documentation as required by local authorities.

Intellectual Property

All designs, plans, and proprietary construction methods remain the intellectual property of Takumi Deckworks unless otherwise specified in writing.

Cancellation and Termination

Project cancellation terms are specified in individual contracts. Generally, cancellations require written notice and may result in charges for work completed and materials ordered.

Termination for Cause

Either party may terminate agreements for material breach, with appropriate notice and opportunity to cure as specified in project contracts.

Dispute Resolution

Disputes will be resolved through good faith negotiation. If necessary, disputes will be subject to binding arbitration under Japanese law in Tokyo, Japan.

Governing Law

These terms are governed by Japanese law and subject to the jurisdiction of Tokyo courts. All construction work complies with applicable Japanese building codes and regulations.

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and take effect immediately upon posting.
